Nothing in these terms and conditions shall affect consumers' statutory rights.

CONDITIONS OF SALE

1.

GOODS are despatched against cleared payment.

2.

UNPAID CHEQUES – subject to a re-banking charge of £15.00 + VAT for each re-presentation. 

3.

WE DO NOT SUPPLY goods on SALE OR RETURN basis. 

4.

RETURNS.  Where goods have been despatched in accordance with the customer's order, returns will not be accepted unless the mistake is by Gilmex/Binding Bazaar and then we shall honour our obligation.

IN ALL CASES A RETURNS AUTHORISATION NUMBER MUST BE OBTAINED.

No liability is accepted for any direct costs relating to damage.

5.

CLAIMS.  Customers are requested to note that goods should be checked immediately upon arrival.  Claims for loss or damage must be made within 3 days of receipt.  Damage must be stated on delivery note.  In any event, the limit of our liability is restricted to the invoice price of the defective goods.  Any other consequential loss is excluded.

6.

PRODUCTION DELAYS.  The time quoted for despatch shall be adhered to as closely as is possible, but no responsibility is accepted by the Company for  unforeseen delays, or any circumstances not within the control of the Company, causing delay in manufacture, transport or delivery.

7.

SPECIFICATION of items is subject to alteration without notice.

8.

PVC and other materials are offered and sold on the understanding that it is the Buyer’s responsibility to check suitability for use envisaged. 

9.

PRICES quoted are subject to amendment without notice and orders only accepted for invoicing at the price ruling at the date of despatch.  VAT is charged in addition on all items at the current rate.

10. 

TRANSFER OF PROPERTY.  Where goods are sold to the purchaser, the ownership of such goods shall not pass to the purchaser but shall remain vested in the vendor until such time as payment in full thereof is made by the purchaser.  The purchaser shall be responsible for the maintenance and care of such goods and for any storage costs in respect thereof. Notwithstanding the reservation of ownership in such goods by the vendor, the risk relating to such goods shall pass to the purchaser, and the purchaser shall indemnify the vendor against any damage caused thereof before payment in full has been made.  Delivery.  The Buyer shall be bound to accept the goods when they are ready for delivery by the Vendor.

ORDERS under £100.00 net subject to a £11.50 despatch charge.

12.

OFF MAINLAND AND HIGHLANDS.  An additional despatch charge will apply.

13.

ORDERS accepted by the VENDOR will be subject to these conditions of Sale.  No other conditions shall apply unless expressly agreed in writing.

14.

JURISDICTION AND LAW.  These Conditions and any act or contract to which they apply shall be governed by English Law and any dispute arising out of any act or contract to which these conditions apply shall be subject to the exclusive jurisdiction of the English Courts. 

15.

We reserve the right to refuse to accept any order. 

16.
